Property Rights and the fifth amendment
The fifth amendment provides American citizens with several different rights. The amendment states that in criminal processes citizens are guaranteed rights to a grand jury, protects against double jeopardy, and self-incrimination. Also, the fifth amendment protects citizens’ rights to the due process of law if their rights to life, liberty, and property are being denied. This amendment also requires the government to compensate citizens when their private property is taken for public use. The article discusses property laws in Ohio and Pennsylvania. New laws have been put into place in both states to better protect citizen’s rights to their property. The new laws prohibit the government from taking people’s private land for private use. The government can only take private land for public use. The article discusses the laws in Ohio and Pennsylvania and their relation to the fifth amendment. The court cases in Ohio and in Pennsylvania brought into question the Public Use Clause and whether these rights were being infringed upon. It was decided in both states that more rules would be put into place in order to protect the Public Use Clause within the states. I agree with the rulings in both cases. The rulings further explained what the government considers “public use”.
The issues with this Amendment continue to affect young Americans because it is becoming more and more common for people’s property to be taken from them. More and more of the land in the country is being taken by the government and being used for private use and pipelines that are destroying the environment and sacred Native American land. It is important for young Americans to be aware of this and be protected from this. Now more than ever, it is important for young Americans to stay informed on current events in the country and have a better understanding of the Constitution and the rights that are given to them, in the fifth amendment and the rest of the Constitution.
